These Terms of Service ("Terms") govern your access to and use of Xero Inbox ("Service"), operated by AI Escape ("we", "our", or "us"). By using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Xero Inbox, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Service.

2. Description of Service

Xero Inbox is an AI-powered email management service that helps you organize, prioritize, and manage your email inbox. The Service includes:

  • AI-powered email triage and categorization
  • Email summaries and insights
  • Automated actions and suggestions
  • Multi-inbox management

3. Account Registration

To use our Service, you must:

  • Be at least 18 years of age
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized account access

You are responsible for all activities that occur under your account.

4. Email Account Access

To provide our Service, you must connect your email accounts through OAuth authentication. By connecting your email accounts, you:

  • Authorize us to access your email data as described in our Privacy Policy
  • Understand we process emails in real-time but do not permanently store email content
  • Confirm you have the right to grant this access
  • Understand you can revoke access at any time through your email provider's security settings

5. Subscription and Payment

5.1 Free Trial

We offer a 30-day free trial for new users on the Solo plan. No credit card is required to start your trial.

5.2 Subscription Plans

After your trial, continued use requires a paid subscription. Subscription plans are billed monthly based on your selected tier.

5.3 Payment

Payments are processed through a secure, PCI-compliant payment processor. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

5.4 Refunds

We offer refunds on a case-by-case basis. If you're unsatisfied with our Service within the first 30 days of your paid subscription, contact us at [email protected] to discuss a refund.

5.5 Plan Changes

You may upgrade or downgrade your subscription plan at any time. Changes take effect at the start of your next billing cycle.

6. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Violate any applicable laws or regulations
  • Attempt to access accounts or data belonging to others
  • Interfere with or disrupt the Service or its infrastructure
  • Circumvent any security measures or usage limits
  • Use the Service to send spam or unsolicited communications
  • Reverse engineer or attempt to extract our source code
  • Resell or redistribute the Service without authorization

7. Intellectual Property

The Service, including its design, features, and content, is protected by copyright, trademark, and other intellectual property laws. You retain ownership of your email content; we claim no ownership over your data.

8. AI and Automated Processing

Our Service uses artificial intelligence to process and analyze your emails. You acknowledge and agree that:

  • AI-generated recommendations and suggested actions are provided as assistance only and may not always be accurate or appropriate for your specific situation
  • You are solely responsible for reviewing, evaluating, and approving any AI-recommended actions before they are executed
  • Once you approve an action recommended by our AI, you assume full responsibility for the consequences of that action
  • AI models may be updated to improve service quality, which may change recommendations over time
  • We may use anonymized, aggregated data to improve our AI models

8.1 User-Approved Actions

When you approve an action recommended by our AI (such as sending, archiving, or deleting emails), you acknowledge that:

  • The approval constitutes your informed consent to execute that action
  • You have had the opportunity to review the recommended action before approval
  • We are not liable for any consequences resulting from actions you approved
  • Approved actions may be irreversible depending on your email provider's capabilities

9. Service Availability

We strive to maintain high service availability but do not guarantee uninterrupted access. We may:

  • Perform scheduled maintenance with advance notice
  • Experience occasional downtime due to technical issues
  • Modify or discontinue features with reasonable notice

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory
  • We expressly disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill
  • Our total aggregate liability for any claims arising from or related to these Terms or the Service shall not exceed the total amount you paid to us in the twelve (12) months immediately preceding the claim

10.1 AI Recommendations and Approved Actions

WITHOUT LIMITING THE FOREGOING:

  • We are not responsible or liable for any consequences arising from AI-generated recommendations, whether or not you acted upon them
  • We are not liable for any loss, damage, or harm resulting from actions you approved or authorized through the Service
  • You assume all risk associated with relying on AI recommendations or approving automated actions
  • We are not responsible for any emails sent, deleted, archived, or otherwise modified as a result of your approved actions
  • We are not liable for any missed communications, lost business opportunities, or relationship damages resulting from AI recommendations or approved actions

10.2 Third-Party Services

We are not liable for any issues arising from your email provider (Gmail, Outlook, etc.) or any third-party services integrated with our Service.

11. Indemnification

You agree to indemnify and hold harmless Xero Inbox and its affiliates from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

Either party may terminate this agreement:

  • You may cancel your subscription at any time through your account settings
  • We may suspend or terminate accounts that violate these Terms
  • Upon termination, your access to the Service will end
  • We will delete your data in accordance with our Privacy Policy

13. Dispute Resolution

Any disputes arising from these Terms will be resolved through:

  • Informal negotiation in good faith
  • Binding arbitration if negotiation fails
  • Arbitration conducted under AAA rules

You agree to waive any right to participate in class action lawsuits.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of such courts.

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
